Article 322 of Regulations 45 (and corresponding articles of subsequent Regulations) defines 'distributive' as meaning 'proportionate.' The tax is thus imposed upon the partner's proportionate share of the net income of the partnership, and the fact that it may not be currently distributable, whether by agreement of the parties or by operation of law, is not material.
How often courts cite the case defining “distributive share”
Court decisions citing the opinion that defined “distributive share” — 265 in all, by decade. Counts are citations to the defining case as a whole, not verified uses of the term. The dip in the most recent years is a data-coverage gap, not a real trend — our corpus holds fewer opinions from the latest years.
