In Scotch law. A writ commanding a person to enter heir to his predecessor within forty days; otherwise, an action to be raised against him as if he had entered. The heir might appear and renounce the succession, whereupon a decree cognitionis causa passed, ascertaining the creditor's debt. If the heir did not appear, he then became personally liable to the creditor. A charge was either general, or special, or of constitution against the unentered heir substituted.
