Covenant

The action a contract under seal. Covenant to stand seised. uses, in which, in covenants to stand seised the possession is vested solete. Covert Covered; protected. Coverture: the condition the protection of a husband.

In practice. The name of a writ, or action (L. Lat. hreve de conventions,) that anciently lay for non-performance of any covenant in writing. Reg. On^. 165— 167. i^. iV^. ^. 146. ft might be brought for the recovery of land, or any thin^ issuing out of lands, or of moveables. CrcM's Hist. Eng. Law, 214, 290. According to Mr. Reeves, it was first given by the statute of Wales, (statutum Wallioe,) and he says that no forms of it are mentioned by Bracton or Fleta. 2 Reeves' Hist, Eng. Law, 262. Such a writ, however, is clearly mentioned by Bracton in more than one passage. Si quis a conventions recedat, succurritur alteri parti per actionem de conventione; if any one withdraw from [refuse to perform] his covenant, the other party has a remedy by an a4;tion of covenant.
