A mode of acquiring a benefice by deed of gift alone, without presentation, institution, or induction.

The act by which the owner of a thing voluntarily transfers the title and possession of the same from himself to another person, without any consideration.

A donation, as defined by the civil law, is a contract whereby a person gratuitously dispossesses himself of something by transferring it to another to be his property, who accepts it. It is a contract or agreement, and must be accepted by the donee, otherwise it would be a mere offer. It must also be gratuitous, because otherwise, it would be a sale or exchange.
