A small circumstance attending an act may change the law. MODIUS (Lat.) In old English law. A bushel. Cowell; Spelman. A larger measure, of uncertain quantity. Id. A measure of land. Id. MODO ET FORMA (Lat. in manner and form). In pleading. Technical words used to put in issue such concomitants of the principal matters as time, place, etc., where these circumstances were material. Their use when these circumstances were immaterial was purely formal. The words were translated literally, when pleadings began to be made in English, by "in manner and form." See Lawes, PI.
