Lat. Of the bench. A term formerly applied in England to the justices of the Court of Common Pleas, or Bench, as it was originally styled. Bex jus Htiariis suis de banco, salutem; the king to his justices of the bench, greeting. Beg. Orig. 19, et passim. Coram justitiariis nostris de banco; before our justices of the bench. Id. 168, et passim. A distinction was made between the phrases curia nostra de banco, (our court of the bench,) and curia de banco nostro, (the court of our bench;) the former being held to signify the Common Bench or Common Pleas, the latter the King's Bench. 1 Stra. 302.
