    (Civil Law) An oath upon which the cause rested where a party elected to leave the issue to the oath of his adversary.

Where one of the parties to a suit, not being able to prove his charge, offered to refer the decision of the cause to the oath of his adversary, which the adversary was hound to accept or tender the same proposui back again, otherwise the whole was taken as confessed by him.
