A writ prohibiting an ordinary from taking a pecuniary mulct imposed upon a clerk of the king’s for non-residence. Cowell. NON SUBMISSIT (Lat.). The name of a plea to an action of debt on a bond to perform an award, by which the defendant pleads that he did not submit. Bacon, Abr. Arbitration, etc. (G). NON SUM INF0RMATUS (Lat.). I am not informed. See Judgment. NON TENENT INSIMUL (Lat. they do not hold together). A plea to an action in partition, by which the defendant denies that he holds the property which is the subject NON TENUIT (Lat. he did not hold). The name of a plea in bar in replevin, when the defendant has avowed for rent-arrear, by which the plaintiff avows that he did not hold in manner and form as the avowry alleges. Rose. Ileal Act. 62S.
