Drawer without funds

his drawing without funds, property or authority, puts the transaction out of the pale of commercial usage and law; and as he can in no wise suffer by the want of notice of the dishonour of his drafts, that it is deemed an useless form. 'Notice, therefore, can amount to nothing, for his situation cannot be changed.' In a case where he has no fair pretence for drawing, there is no person on whom he can have a legal or equitable demand, in consequence of the non payment or non acceptance of the bill.
