A defence to an action on grounds which, prior to the passing of the Common Law Procedure Act (17 and 18 Vict. c. 125), would have been cognizable only in a court of equity. Moz. & W. The codes of procedure and the practice in some of the states likewise permit both a legal and equitable defence to the same action.
