Money expended in procuring the interment of a corpse. The nature and extent of the allowance for funeral expense varies with the solvency of the estate, and the discretion of the surrogate, so that it is impossible to define the scope of the terms. 3 Redf. Money expended in procuring the interment of a corpse. The person who orders the funeral is responsible personally for the expenses, and if the estate of the deceased should be insolvent, he must lose the amount. But If there are assets sufficient to pay these expenses, the executor or administrator is bound, upon an implied assumpsit, to pay them; 1 Campb. 298; Gregory v. Hooker’s Adm’r, 8 N. C. 394, 9 Am.
