ET NON APPArere. It is the same thing not to be as not to appear. Jenk. Cent. Cas. 207. Not to appear is the same thing as not to be. Broom, Leg. Max. 165. IDEM EST NON PROBARI ET NON ESse; non deficit jus, sed probatio. What does not appear, and what is not, are the same; it is not the defect of the law, but the want of proof. same as to know. This maxim is applied to the duty of every one to know the law.
