Under the English bankruptcy act of 1861 (sections 76-85), these summonses might be issued against both traders and nontraders', and, in default of payment of, or This act was repealed by 32 & 33 Vict. c. 83, § 20. 32 & 33 Vict. c. 71, however (bankruptcy act 1869), provides (section 7) for the granting of a "debtor's summons," at the instance of creditors, and, in the event of failure to pay or compound, a petition for adjudication may be presented, unless in the events provided for by that section.
