From 76 U.S. 290 - Burnett v. Caldwell · 1869Most cited · 20 citing opinions
If the contract stipulates for possession by the vendee, or the vendor puts him in possession, he holds as a licensee. The relation of landlord and tenant does not subsist between the parties. The characteristic feature of that relation is wanting. The vendee pays nothing for the enjoyment of the property. The case comes within the category of a license.

A person to whom a license has been granted. Invitation. In a strict and legal sense there is a distinction between a mere licensee and one who comes upon the premises of another by invitation, express or implied. While in a general sense one upon the premises of another by invitation is a licensee, in a legal sense an invitation gives the visitor a different status from that of a licensee, and entitles him to a somewhat higher degree of care from the owner. 141 111. App. 437; 200 111. 122; 235 111. 526. Naked Licensee. A person on premises by permission of law but without invitation from the owner is a mere naked licensee. 179 111. App. 604; 143 111. 189.
