The mere laying up of a vessel engaged in the latter service would not change its character, unless the government did something affirmative to make it a public vessel. . . . The words of the proviso may reasonably and more liberally be interpreted as a limitation that the vessel is a merchant vessel and shall not have lost its character as such.
