16 U.S.C. § 539M — in this section
The term “new use” means—
(i) a use that is not occurring in the Area as of February 20, 2003; and
(ii) an existing use that is being modified so as to be significantly expanded or altered in scope, dimension, or impact on the land, water, air, or wildlife resources of the Area.
21 U.S.C. § 355 — under this section (7 versions over time)
the term “new use” means a use of a contrast agent that is described in the approved labeling of an applicable medical imaging device described in section 360j(p) of this title, but that is not described in the approved labeling of the contrast agent; and
