The Cyclopedic Law Dictionary

Walter A. Shumaker and George Foster Longsdorf; ed. James C. Cahill · 1922

The continuation of an action which has abated by the death or disability of a party, or a transfer of the cause of action. At common law, this was effected by a bill in equity (see "Bill of Revivor"), but in most of the states, a proceeding on application to the court in which the action was pending has been substituted.
