Public Highway

One under the control of and kept by the public, established by regular proceedings for the purpose, or generally used by the public for twenty years, or dedicated by the owner of the soil and accepted by the proper authorities and for the maintenance of which they are responsible. State v. Gross, 119 N. O. 868, 26 S. E. 91. It includes roads, streets, alleys, and lanes, laid out or erected as such by the public, or dedicated or abandoned to the public by the owner; Patterson v. Munyan, 93 Cal. 128, 29 Pac. 250. A railroad is a public highway; Venable v. R. Co., 312 Mo. 103, 20 S. W. 493, 18 L. R. A. 68; but not a road on paper; In re Youghiogheny Bridge, 182 Pa. 638, 38 Atl. 478; nor, it is said, is a turnpike; Buncombe Turnpike Co. v. Baxter, 32 N. C. 222. See Highway; Rates.
