In civil law. The name of an action given to one who had contracted with a son or slave, by order of the father or master, to compel such father or master to stand to the agreement. Halifax, Civ. Law, bk. 3, c. 2, No. 3; Inst. 4. 7. 1; Dig. 15. 4. QUOD JUSSU ALTERIUS SOLVITUR pro eo est quasi ipsi solutum esset. That which is paid by the order of another is, so far as such person is concerned, as if it had been paid to himself. Dig. 50. 17. 180.
