Obligation of a stipulator is the same as that of a surety, and consequently his liability is limited by the terms of his contract.

In the civil law, the party who asked the question in the contract of stipulation; the other party, or he who answered, being called the "promissor." But, in a more general sense, the term was applied to both the parties. Calv. Lex. STIRPES (Lat.) Descents. The root, stem, or stock of a tree. Figuratively, it signifies in law that person from whom a family is descended, and also the kindred or family. See "Per Stirpes." 2 Bl. Comm. 209.
