Where records were made by taking a matrix from the commercial records of a manufacturer of talking machines, making copies of them and selling them at about half price, it was held that, aside from any question of infringement of trade mark or imitation of label or deception of the public, the manufacturers of the original records were entitled to an injunction; Fonotipia, Limited, v.
