Words of reference, and when the time and place have once been named with certainty, it is sufficient to refer to them afterwards by these words. State v. Cotton, 24 N. H. 146. Where an averment merely declares a legal conclusion, the words “then and there” need not be repeated to it. State v. Willis, 78 Me. 74, 2 Atl. 848.
