Torpedo

A train of cars passed over, leaving unexploded, a signal torpedo, which was picked up by a boy at a point where the public were accustomed to cross the track as the railroad authorities knew. While attempting to open the torpedo it exploded and injured a companion, the plaintiff. Held, that the plaintiff could recover damages; and that the fact that the torpedo had been used contrary to rules did not exempt the company from liability.
