the term "mass transportation" has the meaning given to that term in section 5302(a)(7) 2 of title 49, except that the term includes intercity bus transportation 3 school bus, charter, and sightseeing transportation and passenger vessel as that term is defined in section 2101(22) of title 46, United States Code;
