IN CHARTA don! sul manlfeste expressa observetur. The will of the donor, clearly expressed in the deed, should be observed. Co. Litt. 21a. VOLUNTAS EST JUSTA SENTENTIA de eo quod quis post mortem suam fieri veiit. A will is an exact opinion or determination concerning that which each one wishes to be done after his death. VOLUNTAS ET PROPOSITUM DISTINguunt maieficla. The will and the proposed end distinguish crimes. Bracton, 2b, 136b. VOLUNTAS FACIT QUOD IN TESTAmento scriptum valeai.
