A statute declaring sureties in a bond for the jail liberties to be liable, " if the prisoner walk out of the said grounds," must have a construction according to the intent of the legislature. " Walking out " of the grounds means such a walking out as before the passage of the act would have been an escape; a walking out by which the execution creditor is damnified. The expression does not include a casual and momentary stepping over an imaginary line, without knowledge thereof, and not followed by any escape or departure. Howard v. Blackford, 3 N. J. L. 777.
