INSTRUMENTA- RY, in the Scotch law, is he who has attested a deed or other writing. When witnesses attest a deed without knowing the grantor, and seeing him subscribe, or hearing him own his subscription, and the deed happens to be forged, the witnesses are declared accessory to forgery, 1681, c. 5; Ersk. Pr. L. Scot. 4, 4, 37.
