Medical malpractice law addresses harm caused when a health care provider fails to deliver care that meets accepted professional standards. It applies to doctors, nurses, hospitals, and other providers who treat patients.

Common situations include misdiagnosis or delayed diagnosis, surgical errors, medication mistakes, birth-related injuries, and failure to obtain a patient's informed consent before treatment. Importantly, a poor or unexpected medical outcome is not automatically malpractice; medicine carries inherent risk, and the law focuses on whether the provider's care was unreasonably deficient.

Key concepts a non-lawyer should understand include the 'standard of care,' meaning what a reasonably skilled provider would have done in similar circumstances; the need to show that a departure from that standard actually caused the injury; and the central role of expert medical testimony, since these cases almost always require qualified professionals to explain what proper care looked like.

People typically consult a medical malpractice attorney when they suspect a serious injury resulted from a clear mistake rather than the ordinary risks of treatment. Because these claims are complex, time-sensitive, and require expert review, an early legal and medical evaluation is usually the practical starting point for understanding whether a valid claim exists.
