Motorcycle accident law covers claims by motorcyclists who are injured in crashes, as well as claims by their passengers. Because riders have little physical protection compared with people in enclosed vehicles, motorcycle crashes often result in serious injuries, and the legal claims that follow tend to focus on significant medical needs and long-term effects.

Most motorcycle accident claims rest on negligence — whether a driver, the motorcyclist, or another party failed to use reasonable care. Common scenarios include other motorists failing to see or yield to a motorcycle, unsafe lane changes, and hazardous road conditions. Fault can be shared, and in many places a person's own share of fault can reduce the compensation they may recover.

One issue that frequently arises in these cases is bias. Riders sometimes face unfair assumptions that they are inherently reckless, which can affect how insurers and others view a claim even when the rider was careful. For a non-lawyer, it helps to know that fault is decided on the actual facts — such as how the crash occurred — not on stereotypes, and that local rules on insurance and shared fault can shape the outcome. Injured riders often consult a lawyer when injuries are serious, fault is disputed, or an insurer minimizes the claim.
