Real estate law governs the ownership, transfer, financing, and use of land and the buildings on it. It applies to homes, commercial properties, and land itself, and it covers both routine transactions and disputes over property rights.

Common matters include buying and selling property, the contracts and closings involved in those transactions, financing and mortgages, questions of title and ownership, boundary and easement disputes, and conflicts between neighbors or co-owners. It also touches leasing and the various legal documents that establish and protect interests in property.

Key concepts a non-lawyer should understand include the importance of clear title, meaning ownership free of unexpected claims or defects; the central role of written contracts in real estate transactions, since property agreements generally must be in writing; the function of recorded documents that establish who owns or has an interest in a property; and the typical multi-step nature of a property transaction, which involves several parties and a closing process. Mistakes in these areas can be costly and difficult to undo.

People typically consult a real estate lawyer when buying or selling property, especially a significant or complex transaction, when a title or ownership question arises, or when a dispute develops over boundaries, easements, or property rights. Legal guidance helps protect a buyer, seller, or owner's interests.
