Special Needs Planning Law

Special needs planning law is a branch of estate planning that focuses on securing the long-term financial well-being of people with disabilities—including physical, cognitive, or developmental conditions—without disqualifying them from government benefit programs such as Supplemental Security Income (SSI) or Medicaid. Because many of these programs impose strict asset and income limits, a direct inheritance or financial gift can inadvertently make a person ineligible for the very benefits they depend on.

The central tool in this field is the special needs trust (also called a supplemental needs trust), a legal arrangement that holds assets for a beneficiary's benefit while preserving their eligibility for means-tested public benefits. Attorneys in this area also draft letters of intent, coordinate with guardianship or conservatorship proceedings, advise families on ABLE accounts, and help structure settlements from personal injury or medical malpractice cases involving a person with disabilities.

Common situations include parents planning for an adult child with autism or intellectual disabilities, families arranging care after a disabling accident, and guardians managing inherited assets for a ward. The rules governing trust structures, benefit eligibility thresholds, and required court approvals differ significantly from state to state and are subject to change as federal and state law evolves, so any planning in this area should be reviewed by a qualified attorney familiar with the laws of the relevant jurisdiction.
