The procurement officer or the head of a contracting agency may vary the clauses adopted under AS 36.30.430 for inclusion in a particular state contract if the (1) variations are supported by a written determination that states the circumstances justifying the variation; and
(2) approval required by AS 36.30.340 is obtained.
