Notice of escape to victim or victim's next of kin

(1) Whenever an inmate serving a sentence for the commission of a crime escapes from the custody of the Division of Correction, it shall be the responsibility of the division to immediately notify the victim of the crime or the victim's next of kin of the inmate's escape.

(2) However, the victim of the crime or the victim's next of kin will not be notified by the division unless a request for the notification has previously been delivered in writing to the division.

(3) When notice of an escape is given by the division, it shall be conveyed by telephone whenever possible and otherwise in writing to the last known address of the victim or the victim's next of kin.

(4) It shall be the responsibility of the victim or the victim's next of kin to notify the division in writing of any future changes in the victim's or victim's next of kin address and telephone number.

(5) It shall be the responsibility of the prosecuting attorney of the county from which the inmate was committed to notify the victim or the victim's next of kin that an address and telephone number may be provided to the division, and the procedure by which to supply information, for the purpose of notification should the inmate escape.
