Petition to establish

Known as the Wastewater Treatment Districts Act

The act spans §§ 14–14 (15 sections).

(1) When resolutions proposing creation of a regional wastewater collection and treatment district are passed by the councils or other governing bodies of two (2) or more municipalities, a petition to establish a regional wastewater collection and treatment district may be submitted to the circuit court of a county which contains a significant portion of the proposed district.

(2) The petition shall contain a duly executed resolution from each entity authorizing each entity to be included in the district, provided that, in any unincorporated area, fifty-one percent (51%) of property owners by number shall approve by petition before being included in the district. The petition shall also contain: An accurate description and a map of the area to be served initially;

(3) A brief statement showing the need for formation of the district and describing the benefits to be received by residents or property owners in the area;

(4) The proposed name of the district;

(5) The proposed location of the principal office of the district; and

(6) A bold heading stating that a signature on the petition is a vote to create the district.
