Penalties — Enforcement

(1) Any person who violates any provision of this subchapter shall be guilty of a misdemeanor and subject to imprisonment not to exceed six (6) months or a fine not to exceed ten thousand dollars ($10,000), or both.

(2) For a continuing offense, each day during which the offense is committed shall be considered a separate violation.

(3) The Arkansas Natural Resources Commission shall enforce its rules and orders by any or all of the following means: Revocation of any permit or suspension from any program administered by the commission;

(4) Suit for injunction or for damages, or both; and

(5) Civil penalties not to exceed ten thousand dollars ($10,000).

(6) All penalties received shall go to the Arkansas Water Development Fund.
