Minimum stream flows

(1) The Arkansas Natural Resources Commission shall establish and enforce minimum stream flows for the protection of instream water needs.

(2) Prior to the establishment of minimum stream flows, the Arkansas Natural Resources Commission shall notify by certified mail, return receipt requested, the Arkansas State Game and Fish Commission, the Division of Environmental Quality, and any other interested state boards and commissions.

(3) Within thirty (30) days of receipt of notice, the Arkansas State Game and Fish Commission and the division shall file written comments with the Arkansas Natural Resources Commission.

(4) In establishing minimum stream flows, the Arkansas Natural Resources Commission shall follow the procedure for rulemaking, including publishing notice and the conducting of a public hearing.

(5) Nothing in this section shall be construed to override any other duties or powers of the Arkansas Natural Resources Commission.
