Ark. Code Ann. § 15-74-401

Penalty

(1) A dealer shall be guilty of a misdemeanor and upon conviction shall be fined in any sum not less than fifty dollars ($50.00) nor more than five hundred dollars ($500), if that dealer: Offers for sale any of the oils or fluids mentioned in this subchapter which: Have not been tested; or

(2) Having been tested, fail to comply with the specifications set out in this subchapter; or

(3) Fails to comply with all the requirements of any section of this subchapter or rules promulgated by the Secretary of the Department of Finance and Administration under authority of this subchapter.

(4) However, the secretary, or any of his or her deputies or inspectors, shall have the power to compromise the penalty herein fixed by imposing the penalty as the merits of the case demand.
