Discharge of garnishee

Civil Code, § 244; C. & M

(1) The garnishee may pay the money owing to the defendant by him or her to the county sheriff having in his or her hands the order of attachment or into the court.

(2) He or she shall be discharged from liability to the defendant for any money so paid, not exceeding the plaintiff's claim.

(3) He or she shall not be subjected to costs beyond those caused by his or her resistance of the claim against him or her.

(4) If he or she discloses the property of the defendant in his or her hands or the true amount owing by him or her and delivers or pays the amount owing according to the order of the court, he or she shall be allowed his or her costs.
