Time and method of sale

(1) All property taken in execution by any officer shall be exposed to sale on the day for which it was advertised, between the hours of 9:00 a.m. and 3:00 p.m., publicly, by auction, for ready money, and the highest bidder shall be the purchaser.

(2) The sale of real estate is not required to be made upon a court day, but it may be made at any other time, after being duly advertised.

(3) The sale is to be made at the courthouse door unless, at the request of the defendant who owns the land, the officer shall appoint the sale upon the premises.

(4) Where there has been one (1) failure to sell for want of bidders, the officer may appoint the sale at the courthouse door, or on the premises, as he or she shall deem most likely to secure a fair sale.
