Ark. Code Ann. § 17-104-312

Violations

Known as the Perfusionist Licensure Act

The act spans §§ 17-104-101 to 17-104-313 (18 sections).

The Department of Health shall revoke or suspend a license, place on probation a person whose license has been suspended, or reprimand a licensee upon a determination of:

(1) Any violation of this chapter;

(2) Any violation of a rule or code of ethics adopted by the State Board of Health; or

(3) Unprofessional conduct, which includes, but is not limited to: Incompetence or gross negligence in carrying out usual perfusion functions;

(4) A conviction of practicing perfusion without a license or a provisional license;

(5) The use of advertising relating to perfusion in a manner which violates state law;

(6) Procuring a license or provisional license by fraud, misrepresentation, or mistake;

(7) Making or giving any false statement or information in connection with the application for the license or provisional license;

(8) A plea of guilty, nolo contendere, or a finding of guilt of a felony listed under § 17-3-102 or any offense substantially related to the qualifications, functions, or duties of a perfusionist, in which event the record shall be conclusive evidence; or

(9) Impersonating an applicant or acting as proxy for an applicant in any examination required under this chapter for the issuance of a license.
