Issuance and recording

Known as the Arkansas Respiratory Care Act

The act spans §§ 17–17 (18 sections).

(1) The Arkansas State Medical Board shall register as a respiratory care practitioner each applicant who provides evidence of his or her fitness for licensure under the terms of this chapter.

(2) It shall issue to each person registered a license, which shall be prima facie evidence of the right of the person to practice respiratory care, subject to the conditions and limitations of this chapter.

(3) Proof of licensure must be made upon request.

(4) Whenever the board determines for any reason not to issue a license, it shall enter an order denying the application.

(5) Whenever the board determines for any reason to suspend, revoke, or refuse to renew a license, it shall enter an order taking that action.

(6) All review proceedings shall be governed by the Arkansas Administrative Procedure Act, § 25-15-201 et seq.
