As used in this subchapter:
(1) “Council” means the State Interagency Council;
(2) “Developmental delay” means a child is delayed in any one (1) or more of the following areas: Physical development;
(3) Cognitive development;
(4) Language and speech development;
(5) Psycho-social development; or
(6) Self-help skills;
(7) “Early intervention services” means developmental services which: Are provided under public supervision through licensure or for accreditation by the appropriate state agency;
(8) Are provided at no cost except when federal or state law, rules, or regulations provide for a system of payments by families, including a schedule of sliding fees;
(9) Are designed to meet the developmental needs of an infant with disabilities or a toddler with disabilities in any one (1) or more of the following areas: Physical development;
(10) Cognitive development;
(11) Language and speech development;
(12) Psycho-social development; or
(13) Self-help skills;
(14) Meet the standards of the state, including the requirements in this section;
(15) Include: Family training, counseling, and home visits;
(16) Special habilitation and education instruction;
(17) Speech pathology and audiology;
(18) Occupational therapy such as fine motor skills;
(19) Physical therapy;
(20) Psychological services;
(21) Case management services at the service delivery level;
(22) Medical services for diagnostic or evaluation purposes;
(23) Early identification, screening, and assessment services; and
(24) Health services necessary to enable the infant or toddler to benefit from other early intervention services;
(25) Are provided by qualified personnel, including: Certified special educators or training technicians supervised by special educators;
(26) Speech and language pathologists and audiologists;
(27) Occupational therapists;
(28) Physical therapists;
(29) Psychologists;
(30) Social workers;
(31) Nurses;
(32) Nutritionists; and
(33) Physicians; and
(34) Are provided in conformity with an individualized family service plan adopted in accordance with this subchapter; and
(35) “Infants and toddlers with developmental delays” means individuals from birth through two (2) years of age, inclusive, who need early intervention services because they: Are experiencing developmental delays as measured by appropriate diagnostic instruments and procedures in one (1) or more of the following areas: Cognitive development;
(36) Physical development;
(37) Language and speech development;
(38) Psycho-social development; or
(39) Self-help skills; or
(40) Have a diagnosed physical or mental condition which has a high probability of resulting in developmental delay or are at risk of having substantial delays if early intervention services are not provided.
