(1) The Department of Health shall create and publish a list of critical items for closure of an establishment.
(2) The department shall list the prohibitions under § 20-27-1511 as critical items for closure.
(3) An establishment that violates a critical item from the list established under subsection (a) of this section is subject to immediate closure by the department.
(4) An establishment closed under subdivision (b)(1) of this section shall remain closed until: Fines or penalties, or both, that are assessed under this subchapter have been paid; and
(5) Upon inspection by the department, the establishment is no longer in violation of a critical item.
