Notice of arrival of freight — Free time

(1) Legal notice as referred to in this section and §§ 23-10-402, 23-10-403, 23-10-405, 23-10-406, 23-10-409 — 23-10-420, and 23-10-422 — 23-10-431 may be either actual or constructive.

(2) Where the consignee or his or her agent is personally served with the notice of the arrival of freight at or before 6:00 p.m. of any day, free time begins at 7:00 a.m. on the day after the notice has been given.

(3) Constructive notice consists of posting notice by mail to the consignee.

(4) Where this mode of giving notice is adopted, there shall be forty-eight (48) hours' additional free time. However, in any case where notice of arrival is given by mail, the notice shall be by registered letter, and that notice shall date from the receipt of the registered letter.
