Area of sales responsibility

Known as the Arkansas Motor Vehicle Commission Act

The act spans §§ 23–23 (104 sections).

(1) The following conditions shall apply to the area of sales responsibility of a dealer included in a dealer agreement: The manufacturer shall designate in the dealer agreement the area of sales responsibility exclusively assigned to the dealer;

(2) The manufacturer shall not change the area of sales responsibility of a dealer or establish another dealer for the same line-make in that area during the term of the dealer agreement; and

(3) The area of sales responsibility shall not be reviewed or changed without the consent of both parties until one (1) year after the execution of the dealer agreement.

(4) A dealer shall not conduct sales activity or display for sale recreational vehicles outside of its designated area of sales responsibility except as provided under § 23-112-901 et seq. and the Rules of the Arkansas Motor Vehicle Commission.

(5) A dealer may sell off-premise or display recreational vehicles within the area of sales responsibility as provided by commission rule.

(6) The dealer shall notify the commission of any change in ownership in accordance with § 23-112-1019.
