Injunction

Known as the Charitable Bingo and Raffles Enabling Act

The act spans §§ 23–23 (43 sections).

(1) If the Department of Finance and Administration has reason to believe that this chapter has been violated, the Secretary of the Department of Finance and Administration may petition a court for injunctive relief to restrain the violation.

(2) Venue for an action seeking injunctive relief against a licensed distributor or a licensed manufacturer is in Pulaski County, Arkansas.

(3) Venue for an action seeking injunctive relief against a licensed authorized organization is in the county where the licensed authorized organization resides.

(4) If the court finds that this chapter has been violated, the court shall restrain the violation by issuing: A temporary restraining order;

(5) After due notice and hearing, a temporary injunction; and

(6) After a final trial, a permanent injunction.
