Violation — Enforcement — Penalties

(1) A person who is subject to the Unified Carrier Registration Act of 2005, Pub. L. No. 109-59, § 4301 et seq., and who uses the highways of this state without first registering in accordance with this subchapter is guilty of a violation.

(2) The Division of Arkansas State Police, the Arkansas Highway Police Division of the Arkansas Department of Transportation, and local authorities may enforce this subsection.

(3) A person who is found guilty or enters a plea of guilty or nolo contendere under this section shall be ordered to pay a fine of: For a first offense, not less than one hundred dollars ($100) or more than five hundred dollars ($500); and

(4) For a second or subsequent offense, not less than one hundred dollars ($100) or more than one thousand dollars ($1,000).

(5) Fifty percent (50%) of the amount of the fines imposed and collected under this section shall be remitted by the tenth day of each month to the Administration of Justice Funds Section on a form provided by the Division of Administrative Services for deposit into the General Revenue Fund Account of the State Apportionment Fund.

(6) Fifty percent (50%) of the amount of the fines imposed and collected under this section shall remain in the jurisdiction in which the violation occurred.
