Priority of primary motor vehicle liability insurance coverage
Acts 2007, No. 373, § 1.
The liability insurance policy covering a motor vehicle is primary when the motor vehicle is driven by:
(1) An insured; or
(2) Any other person: Not excluded from coverage under the policy;
(3) With the permission of an insured; and
(4) When the use of the motor vehicle is within the scope of the permission granted by an insured.
