(1) Notwithstanding any provision of the Transformation and Efficiencies Act of 2019, if a state entity subject to a cabinet-level department transfer under this chapter is subject to Arkansas Constitution, Amendment 33: The state entity subject to Arkansas Constitution, Amendment 33, and the institutions under its authority shall be considered to be affiliated with the cabinet-level department at issue; and
(2) The state entity subject to Arkansas Constitution, Amendment 33, shall perform all functions with respect to the management and control of the state entity and the institutions under its authority as contemplated by Arkansas Constitution, Amendment 33.
(3) The Transformation and Efficiencies Act of 2019 shall not abridge, diminish, or curtail, in any respect, the authority or responsibilities vested in a state entity that is subject to Arkansas Constitution, Amendment 33, and affiliated with a cabinet-level department under the Transformation and Efficiencies Act of 2019.
