Ark. Code Ann. § 27-16-401

Definitions

Known as the Motor Vehicle Driver's License Act

The act spans §§ 27–27 (100 sections).

As used in this subchapter, unless the context otherwise requires:

(1) “Commissioner” means the Secretary of the Department of Finance and Administration acting in his or her capacity as Commissioner of Motor Vehicles of this state;

(2) “Director” means the Director of the Office of Driver Services;

(3) “Driver” means the same as provided in § 27-16-104;

(4) “Serious accident” means: A reportable accident in which the driver is found at fault; and

(5) The accident is placed on the driver's records by the Office of Driver Services; and

(6) “Serious traffic violation” means any violation where the driver's privilege to operate a motor vehicle has by court order or by administrative action been withdrawn or any violation in which a driver has been found guilty of: Any alcohol-related moving traffic violation;

(7) Any seat belt violation;

(8) Any commercial motor vehicle violation;

(9) Driving fifteen (15) or more miles per hour over the speed limit;

(10) Reckless driving;

(11) Negligent homicide;

(12) Using a vehicle to commit a felony;

(13) Failure to carry liability insurance;

(14) Leaving the scene of an accident;

(15) Evading arrest;

(16) Fleeing by use of an automobile;

(17) Unsafe driving;

(18) Hazardous driving;

(19) Prohibited passing;

(20) Passing stopped school bus;

(21) Careless or negligent driving;

(22) Failure to obey a traffic signal or device;

(23) Failure to obey a railroad crossing barrier;

(24) Racing on a highway;

(25) Driving with a suspended, revoked, or cancelled license; or

(26) Driving the wrong way down a one-way street.
